Aversives/Restraints Law (AB 280)
What is AB 280?
Assembly Bill 280 (AB 280) was passed by the Nevada State Legislature in 1999 in response to concerns about the use of aversive interventions and physical or mechanical restraints with students with disabilities. AB 280 prohibits aversive interventions and restricts physical or mechanical restraints in disciplinary, punitive, and behavior intervention contexts, when positive behavioral supports could be used instead.
What if permissible physical restraints are used on a child?
Some physical restraints are permissible and do not require any type of reporting. Some examples of permissible restraints are hand-over-hand assistance, student escorts where there is little or no resistance, and standing tables or lap chairs for positioning purposes. Appropriate notes and/or documentation must be kept, but no reporting is required.
What happens if a physical restraint is used in an emergency situation or a non permissible physical restraint or an aversive intervention is used?
Staff must immediately complete the Incident Report Worksheet Form A or Form B and submit to the Site Administrator. Complete procedures are found at Restraints/Aversives Laws Plan.
