What is an annual IEP?

An Annual IEP must be held for all students in special education. This IEP typically occurs around the same time each year and lasts for one year. It must be held before the end date on the current IEP.

How do I set up an IEP meeting?

Contact the parent by phone to identify a convienent day and time to hold the IEP meeting.If all required IEP members are able to attend at that time, send home a Prior Written Notification (SES 14) and the Invitation to IEP/MDT Meeting (SES 12) reflecting the agreed upon meeting day and time.

How do I create an annual IEP?

All pages in the IEP are included (transition pages are needed for students beginning at the age of 14, including students who are 13, but will be turning 14 during the IEP year). Be sure to include the Testing Accommodations page (SSS-F007) after the Related Services and State District Wide Assessment page in the IEP. The Consent for Release of Information and Medicaid Reimbursement (SSS-F009) is also to be discussed with the parent after the completion of the IEP. If the student is eligible for Medicaid, the parent needs to sign the form. Then a copy of the form, a copy of the IEP, and a copy of the current eligibility are sent to WCSD Medicaid Office at Mill Street. After the IEP is complete, make copies for the parent, the classroom teacher, and any related service personnel.

What if a parent does not show up to the IEP?

If a parent does not show up to an IEP, another attempt at a meeting must be made. Contact the parent by phone again to identify a convienent day and time. Then send home another Prior Written Notification (SES 14) and the Invitation to IEP/MDT Meeting (SES 12) with the new meeting day and time along with a copy of Parental Rights. Be sure to mark Notice 2 on top of the SES 12 form. If a reminder call to the parent before the second meeting has been made and all meeting attempts are noted on the Status Log (page 2 of the IEP folder) and the parent does not show again, then as a last resort you should attempt to hold a teleconference IEP meeting. If the parent is unreachable hold the IEP meeting without the parent.After the meeting, send home a copy of the IEP along with a Prior Written Notification (SES 14) stating that the IEP will be implemented. This should be sent certified mail.  These procedures are outlined in the Reasonable Attempts Checklist (SES CK7)

What if the parent refuses to sign the IEP?

If a parent does not agree with the IEP and refuses to sign, the IEP is still implemented. Either provide the parent with the Prior Written Notification (SES 14) at the meeting or send home the Prior Written Notification stating that the WCSD is proposing to implement the IEP developed for the student on ___ date. (The date is the day you plan to implement the IEP.) Make sure to furnish a copy of the rights with the SES 14.If a parent formally disagrees by requesting a Due Process Hearing, contact your Program Consultant (PC) immediately.

What is Due Process?

If a parent disagrees with their child's identification, evaluation, placement, or the provision of a Free and Appropriate Public Education (FAPE), they have the right to request a due process hearing. To resolve disputes between parents and school districts, both parties have the right to impartial due process and review hearings. Initially, a due process hearing decision will be made by an impartial third person concerning the child's identification, evaluation, placement, or the provision of a free appropriate public education (FAPE). Upon receipt of a written request for a hearing, the school district is required to convene a "resolution session" with the parents and relevant members of the IEP team within 15 days, unless both parties agree to waive the resolution session or agree to use mediation as an alternative. If the complaint is not resolved, then a hearing and decision will be completed within 45 days unless an extension is granted by the hearing officer. An appeal of the hearing officer's decision may be requested by either party, within 30 days of receiving the decision. Thereafter, both parties also have the right to file suit in state or federal court to contest any review decision.
